TRES PALAPAS PICKLEBALL RESORT WAIVER AND RELEASE OF LIABILITY

THIS IS A LIABILITY RELEASE AND WAIVER OF INDEMNITY RELEASE AGREEMENT

The participant listed below (“Participant”) desires to participate and be a spectator in pickleball games, tournaments, and events organized and sponsored by the Mexican Corporation Tres Palapas Pickleball Resort, its owners, representatives, administrators, employees, volunteers and trainers (“TPPR”).

TPPR agrees to organize and provide these activities in exchange for certain fees in accordance with TPPR’s fee schedule, as amended from time to time.

Participant executes this Release with full information and knowledge of the risks associated with pickleball activities, and by knowingly and voluntarily agreeing to its terms. Participant agrees that he/she has signed this Release free of undue influence, duress, coercion or persuasion.

Participant further specifically agrees as follows

1.) Participant acknowledges her/his participation in the activity and understands it involves inherent risks, including but not limited to, collisions with man made and natural objects and or other participants. Said risks include death, injury to the head, face, neck, injury to the back, injury to the knee, ankle, or any other part of the leg and or body, including dislocated joints and injured muscles.

2.) Participant agrees to full discharge TPPR, from all responsibility or liability, for any injuries, of damage to Participant or other third parties, whether resulting from the negligence, acts or omissions of any and all persons or parties involved in TPPR activities.

By signing this document, participant full recognizes that if anyone is hurt, participant has no right to make a claim or file a lawsuit again TPPR.

3.) Participant further understands and agrees that, to the extent Participant also pay TPPR to provides pickleball activities to a minor, the Participant, as parent/guardian or otherwise agrees to save and hold harmless TPPR from any claims made or brought forward.

LIABILITIY WAIVER AND INDEMNITY AGREEMENT

I am fully aware of the risks and hazards connected with pickleball and being around a pickleball facility. I understand that the sport of pickleball is unpredictable and dangerous with increased age.

I voluntarily assume full responsibility for all risks of loss, property damage, or personal injury as a result of being present at TPPR or engaged in any activities at TPPR, whether caused by negligence or

El participante celebra este instrumento informado y con pleno conocimiento de los riesgos asociados a las actividades de pickleball, y acepta voluntariamente todos los términos. El Participante firma este

acuerdo libre de influencia o coacción.

I further hereby agree to indemnify and hold harmless TPPR, the owners of the facility and their heirs, coaches, volunteers and employees part or full time from any loss, liability, damages, claims or costs, including courts costs and lawyer’s fees, that may arise from my participation in any activity at TPPR, whether caused by negligence of TPPR.

It is my express intent that this Release and Hold Harmless Agreement shall bind the members of my family and my heirs, assigns and personal representatives. No member of my family or my estate may commence litigation against TPPR, and I or my estate agree to indemnify and hold harmless the TPPR, the owners of the facility and their heirs, coaches, employees, volunteers and their heirs in the event any member of my family or my estate commence any such litigation.

Any guest brought to RPBPR by me agrees not to commence any legal action against TPPR, owners of the facilitiy, employees, volunteers, coaches or their heirs for any loss or damage sustained on or near the facility.

I understand and acknowledge that I am not permitted to bring or permit any third party access to the facility unless that third party has agreed to accept full responsibility for all risks associated with being at the facility.

I agree to indemnify and hold harmless TPPR, from any and all claims made by any third party.

I understand that I am responsible for any damage to TPPR.

I agree to not engage in any illegal or unlawful acts or activities on the property.

In signing this release, I acknowledge and represent that I have read the foregoing Waiver of Liability and Indemnity Agreement.

I am at least eighteen (18) years of again and I execute this Release for full, adequate and complete consideration fully intending to be bound by the same.
