Hollin Hills Pickleball and Tennis Club
I have had the opportunity to inspect the conditions of the Hollin Hills Pickleball & Tennis Facility, am aware or able to become aware of its condition, and assume the risk of its use. I agree that I am personally responsible for my safety and actions while using the Hollin Hills Pickleball & Tennis Facility. I agree to comply with all Hollin Hills Pickleball & Tennis Club policies and rules, including but not limited to all policies, guidelines, signage, and instructions.
2. If I am the parent/guardian of a minor child, I agree that I am personally responsible for their safety and actions while using the Hollin Hills Pickleball & Tennis Facility, and I agree to direct their compliance with all Hollin Hills Pickleball & Tennis Club policies and rules, including but not limited to all policies, guidelines, signage and instructions. By signing this waiver, I certify that I, as parent/guardian, have read and explained the rules and policies of the pool to my minor child/ward.
3. I understand that using the Hollin Hills Pickleball & Tennis Facility may result in injury or exposure to and illness from various bacterial and viral infectious diseases, including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist, and cannot be entirely eliminated.
4. Assumption of Risk: On behalf of myself and all members of my household who are members of the Hollin Hills Pickleball & Tennis Club, I knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of the Community Association of Hollin Hills and its Hollin Hills Pickleball & Tennis Club and their officers, officials, agents, and/or employees (the “Releasees”), and assume full responsibility for my use of the Hollin Hills Pickleball & Tennis Facility and the use of the Hollin Hills Pickleball & Tennis Facility by my minor children, if any.
5. Release: On behalf of myself, all members of my household who are members of the Hollin Hills Pickleball & Tennis Club, and my and their guests, invitees, and licensees (the Releasors), the Releasors hereby agree to defend, indemnify, release and hold harmless the Community Association of Hollin Hills, the Hollin Hills Pickleball and Tennis Club, and their members, officers, agents, and employees (the Releasees) with respect to any and all claims, demands, actions, or proceedings arising from or relating to the use and operation of the facilities of the Club or the CAHH by the Releasees including but not limited to claims of illness, injury, disability, death, loss, or damage to person or property, whether arising from the negligence of Releasees or otherwise, to the fullest extent permitted by law. If not permitted by law, this lease does not apply to intentional torts or crimes.

6. Member initiation fees are non-refundable and non-transferable.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY DURESS.
