Slips, trips, falls, loss of footing and balance, and collisions.
Physical impact with the premises or equipment, such as balls, paddles, nets, walls, the ground, other surfaces, other parts of the premises, and other equipment.
Equipment such as balls, paddles, nets, and surfaces may fail or may not function appropriately or as expected due to defects, wear and tear, or improper use or installation.
Head injuries, concussions, sprains, strains, fractures, abrasions, rope burns, scrapes, broken bones, tendonitis, bursitis, or other injuries related to connective tissue, overextension, and overuse.
Exhaustion, fatigue, overheating, hypo- or hyperthermia, or respiratory illness or injuries related to overexertion, exercise, exposure to the elements, and lack of fitness or conditioning.
Environmental hazards such as severe weather, allergies, or poor air quality.
Infection, communicable diseases, allergies, and epidemics.
Participants may move and travel between centers, courts, outdoor areas, and other parts of the premises, and all forms of such movement or travel involve the risk of accident and injury.
Delayed access to medical care if medical care is necessary.
Negligence of other participants or persons who may be present, and the potential for people outside of Springs Pickleball to interfere with participant safety.
Property or information theft, misuse, or damage, including from vehicles, equipment, files, or systems.

Policies, Terms and Conditions, and Membership Agreement
PLEASE READ THESE POLICIES, TERMS AND CONDITIONS, AND MEMBERSHIP AGREEMENT CAREFULLY.
At Springs Pickleball, LLC, (“Springs Pickleball,” “our,” or “we”), we have adopted policies, procedures, rules, and regulations, including those located at SpringsPickleball.com/policies (“policies”) designed to provide for the safe, enjoyable, and healthy use of our premises and events by you, our members, and guests. These policies apply to your conduct on Springs Pickleball’s premises, including its centers, courts, and all outdoor areas, including its parking lots, and sidewalks (“premises”). These policies also apply to your conduct during our events or other Springs Pickleball-sponsored activities (“events”).
As a member or guest of Springs Pickleball, you are expected to review these policies and you must comply with them at all times. If you violate any of these policies, your membership, center access, or event participation may be suspended or terminated immediately and without notice. Our decision on all questions regarding construction or interpretation of these policies is final.
We may change these policies at any time without notice, in our sole discretion. You may find the most recent version of these policies atSpringsPickleball.com/policies. As a member or guest of Springs Pickleball, you are responsible and expected to review and comply with these policies at all times.
CANCELLATION OF MEMBERHIP; NO REFUNDS. Each membership is for a period of one year, payable monthly, and subject to automatic renewal unless canceled prior to the beginning of the next billing year. You may cancel at any time, but cancelation is prospective only (i.e., for the next billing year). Cancelation does not entitle you to a refund of any prior payments or to proration of previously paid fees.
EXTENSION OF MEMBERSHIP FOR VERIFIED HEALTH REASON. If a licensed physician verifies in writing that you are unable to access the premises or otherwise participate in Springs Pickleball events due to a physical health condition or impairment, then the period of your membership will be extended at no extra charge for as long as the physical health condition or impairment exists, but in no event longer than one year.
COURT OR EVENT CANCELATIONS. You may cancel a court reservation or other scheduled event by calling Springs Pickleball or by canceling the reservation on the Springs Pickleball CourtReserve app. We will refund all amounts paid if we receive your cancellation notice not less than 24 hours prior to your scheduled reservation date and time. We will not refund any amount for a reservation that you fail to attend or fail to reschedule or postpone at least 24 hours in advance. If a cancellation is made and a refund granted, the refund will be applied as a balance on the guest or member's account.
HEALTH & SAFETY. The health and safety of our members and guests is among our highest priorities. While our policies are designed to help protect you, Springs Pickleball cannot remove all risk or otherwise guarantee or promise that you will not sustain any injuries or damages from viruses, infectious diseases, or other health hazards associated with your use of Springs Pickleball’s premises, facilities, equipment, services, activities, or products.
Use of Springs Pickleball’s premises, facilities, equipment, services, activities, or products can include but is not limited to (1) pickleball courts, lobby, entryways, sidewalks, parking lots, and any other facilities; (2) use of services and participation in activities including but not limited to special athletic events; and (3) all other programs, activities, classes, sessions, events, amenities, or benefits that are sponsored, endorsed, or operated by Springs Pickleball on or off its premises.
By using Springs Pickleball’s premises and/or participating in Springs Pickleball events, you attest, on behalf of yourself, your spouse or partner, your children or other minor members, your invited guests, and heirs, successors, and assigns that you and they are physically and mentally capable of participating in Springs Pickleball activities and have no known health restrictions that might jeopardize your or their health or safety.

PRIVACY POLICY. By applying for membership in or otherwise submitting your information to Springs Pickleball, you hereby grant Springs Pickleball express permission to contact you by telephone and send you prerecorded messages and text messages using automated technology to the telephone number provided.
RELEASE OF LIABILITY AND ASSUMPTION OF RISK. Every person applying for membership in Springs Pickleball, using the premises, or participants in events must agree to and sign the separate “Waiver and Release of Liability,” which is an integral part of this Membership Agreement and constitutes a material inducement hereto.
