ASSUMPTION OF RISK*WAIVER OF LIABILITY*PHOTO RELEASE*MEDICAL AUTHORIZATION
I HEREBY ACKNOWLEDGE that I have voluntarily permitted my child to participate in tennis, swim, waterslide, classes, programs and/or other activities under the direction of GORIN Tennis Academy, Inc.
I AM AWARE THAT TENNIS, PICKLEBALL, OR ANY OTHER PROGRAM OFFERED BY OR UNDER THE DIRECTION OF GORIN TENNIS ACADEMY, INC INVOLVE RISKS OF SERIOUS BODILY INJURY INCLUDING PERMANENT DISABILITY, PARALYSIS AND DEATH; AND I AM VOLUNTARILY PERMITTING PARTICIPANT TO PARTICIPATE IN THESE ACTIVITIES WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACEPT ANY AND ALL RISKS OF INJURY TO PARTICIPANT THAT MAY RESULT THEREFROM.
In exchange for Participant being permitted by Gorin Tennis Academy, Inc to participate in these activities and/or use their facilities, I HEREBY AGREE THAT I WILL NOT MAKE A CLAIM AGAINST OR SUE GORIN Tennis Academy, Inc. or any of its principals, stockholders, employees or agents, for injury or damage resulting from the negligence or other acts, howsoever caused, by any employees or agents of GORIN Tennis Academy, Inc., as a result of Participant’s participation in any activity under the direction of GORIN Tennis Academy, Inc.
I am aware that individual and group publicity photos and videos are taken from time to time, and in consideration for any, or my child(ren’s) participation. I hereby grant my permission for my child, or my child’s likeness, to be used in GORIN Tennis publicity or advertising.
HEREBY RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Tennis Gorin Tennis Academy, Inc and and all of their directors, officers, agents, volunteers and employees, (hereinafter referred to as “Releasees”) FROM ALL LIABILITY TO THE UNDERSIGNED, his/her personal representatives, assigns, heirs and next of kin FOR ANY AND ALL LOSS OR DAMAGE, AND ANY CLAIM OR DEMANDS THEREFORE ON ACCOUNT OF INJURY AND/OR EXPOSURE TO INFECTIOUS SYNDROMES OR DISEASES TO THE PERSON OR PROPERTY OR RESULTING IN ILLNESS AND/OR DEATH OF THE UNDERSIGNED ARISING OUT OF OR RELATED TO THE EVENT(S), WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE. BY PARTICIPATING OR ATTENDING THIS EVENT YOU ASSUME ALL RISKS WHETHER KNOW OR UNKNOWN.
In addition, I HEREBY ACKNOWLEDGE AND AGREE TO RELEASE, DEFEND, INDEMNIFY AND HOLD HARMLESS GORIN Tennis Academy, Inc. It’s principals, stockholders, employees and agents, and ASSUME FULL RESPONSIBILITY FOR ANY LOSS OR DAMAGE AND FOR ANY CLAIM, LAWSUIT OR DEMAND FOR LOSS OR DAMAGE, on account of injury to Participant, whether caused by the active, passive or sole negligence of GORIN Tennis Academy, Inc., its employees or agents, while Participant is on the property of GORIN Tennis Academy, inc., or is participating in any activity under the direction of GORIN Tennis Academy, Inc.
Should it be necessary, in the opinion of a member of the staff of GORIN tennis Academy, Inc. to render first aid and assist to Participant, I hereby grant permission to the staff of GORIN Tennis Academy, Inc. to render such aid and assistance.
I HAVE CAREFULLY READ THIS AGREEMENT AND RELEASE OF LIABILITY AND FULLY UNDERSTAND IT’S CONTENTS.
